Terms of Use

By accessing or using the Services, you are deemed to have read, understood, and accepted this Agreement, the Privacy Policy, and all related policies and updates.

Persons who do not accept these terms may not use the Services.

Curiosity Technology may provide the following services:

• ·Beta products
• ·Test services

The Company may change the scope of services at any time.

The User represents that they are over 18 years of age, or have the legal authority required to use the Services. Corporate users confirm they have authority to act on behalf of their company.

The User is solely responsible for the security of their account credentials and agrees not to share passwords. Curiosity Technology does not guarantee account security and is not responsible for unauthorized access.

The following activities are strictly prohibited:

• ·Source code extraction
• ·Model extraction
• ·Prompt injection attacks
• ·Jailbreak attempts
• ·Security testing without authorization
• ·DDoS attacks
• ·Malware distribution
• ·Spam
• ·Fraud
• ·Phishing
• ·Deepfake misuse
• ·Illegal surveillance
• ·Copyright infringement
• ·Unauthorized data collection
• ·AI model cloning
• ·Reselling services without authorization
• ·Data extraction for competitor model training
• ·Rate limit circumvention
• ·Automated scraping
• ·Benchmark manipulation

Upon detection of a violation, the Company may block access, delete the account, or initiate legal proceedings.

AI systems may produce inaccurate, incomplete, misleading, outdated, or legally incorrect outputs.

Curiosity Technology is not responsible for the accuracy of AI outputs or for any damages arising from them. The User is obligated to independently verify all outputs.

Unless otherwise stated, all rights to the following are owned by Curiosity Technology:

All rights reserved.

The User represents that they hold the rights to the content they upload, that they do not infringe the rights of third parties, and that they act in compliance with applicable law.

The User grants Curiosity Technology a worldwide, irrevocable, royalty-free license over uploaded content, including the rights to process, analyze, store, reproduce, train models, anonymize, develop, and use commercially.

The Company may change, restrict, terminate, modify pricing, set limits on, or completely shut down Services at any time. Prior notice is not required.

For paid services: all payments are in advance, taxes are the User’s responsibility, refunds are not obligatory, and the Company may change pricing at any time. Services may be suspended in the event of payment delays.

API users agree to comply with rate limits, not engage in abuse, not collect unauthorized data, and not bypass security measures.

The Company may restrict API access, revoke keys, and impose usage limits.

Beta or experimental services may be unstable, may cause data loss, may contain security vulnerabilities, and may not be supported. Beta services are provided ”as is.”

The Services may integrate with third-party services. Curiosity Technology is not responsible for third-party content, data breaches, or security issues arising from such integrations.

The User acknowledges that data is processed under the Privacy Policy. The Company may keep logs, analyze usage data, conduct AI training, and perform security monitoring.

Curiosity Technology may at any time suspend an account, remove access, terminate service, or delete data. No reason is required.

Services are provided on an ”AS IS” and ”AS AVAILABLE” basis. The Company makes no warranty of uninterrupted service, accuracy, security, performance, or fitness for a particular purpose.

Curiosity Technology is not liable under any circumstances for data loss, lost profits, business interruption, reputational damage, cyberattacks, AI errors, third-party damages, or indirect damages.

Total liability is limited to the service fee paid by the User in the last 12 months. For free users, liability is zero.

The User agrees to defend, indemnify, and hold harmless Curiosity Technology from all damages arising from their use of the Services, legal violations, third-party claims, data breaches, and damages arising from AI use.

The Company is not liable for:

• ·Power outages
• ·Internet disruptions
• ·Government interventions
• ·War
• ·Embargoes
• ·Pandemics
• ·Cloud infrastructure failures
• ·AI provider outages

Curiosity Technology may aim to comply with the following regulations, but full compliance is not guaranteed:

• ·Artificial Intelligence Act
• ·General Data Protection Regulation (GDPR)
• ·KVKK
• ·CCPA
• ·ePrivacy

The User represents that they are not on international sanctions lists and will not use the Services on behalf of prohibited countries or entities.

Curiosity Technology may assign this Agreement, transfer it to affiliates, or transfer it within the scope of a merger or acquisition. The User may not request prior approval.

The Company may at any time terminate the Agreement, end access, or delete accounts. Upon termination, licenses expire and access rights are revoked.

This Agreement is subject to the laws of the Republic of Turkey. In the event of disputes, Istanbul Courts and Enforcement Offices have jurisdiction.

The invalidity of any provision of this Agreement does not affect the validity of other provisions.

The Company’s failure to exercise any right does not constitute a waiver of that right.

These Terms of Use and the Privacy Policy constitute the entire agreement between the parties.
